With less than 5 days to go, it is mandatory for every assesse who is an individual to link his PAN with his Aadhaar Card and validate the same, failing which would render his PAN invalid.
However it was held by the Apex court that, in case, the assesse does not hold Aadhaar Number, the PAN should not be considered invalid. But where the assesse holds Aadhaar Number he must intimate the same to the Income Tax Department.
If the Aadhaar isn’t linked with PAN, every time the assesse would login to the Income Tax e-filing portal, he/ she would receive a pop up message asking to link Aadhaar with PAN.
Even if the assesse is not assessable to tax, but holds PAN and Aadhaar Number, he must link his PAN with Aadhaar.
This is the most common misinterpretation that those who file their Income Tax return are only required to Link their PAN with Aadhaar.
Last Date to Link PAN with Aadhaar: 31-03-2019
What are the methods to Link PAN with Aadhaar :
- Online (Web Based) : www.incometaxindiaefiling.gov.in
- Offline (Via SMS) : Send SMS to 567679 or 56161.
In case the deadline is missed the PAN allotted to assesse will be considered as invalid.
What does that mean ?
The ITR won’t be processed , it will be treated as if the return has not been filed at all.
Assessee may get notice for Non Filing of return u/s 142(1) and shall be liable to pay penalty for Non-filing of Return amounting to Rs. 5000/-. Assessee would also be subject to all the provisions under the Income Tax Act for Non Filing of Income Tax Return.

In cases where the PAN and Aadhaar are yet to be linked or where there is data mismatch the user will get an error message on his screen.
In that case the assessee must rectify either of the documents, PAN or Aadhaar so as to complete the process of linking these two records
